What is a prenuptial agreement?
A prenuptial agreement is a contract that sets out how your property and assets will be divided in the event that your relationship breaks down.
Prenuptial agreements in Spain can be made before, during or after the relationship (whether a marriage or a de facto relationship). Some of the common assets and property that you can protect include: pension entitlement, real estate, a trust, investments, family business, an entitlement to an inheritance, superannuation, cash.
Debts and liabilities of the relationship are also included in the concept of property.
When you and your spouse (or spouse-to-be or ex-spouse) agree how your property is to be divided, it is important to do it in accordance with law. A prenuptial agreement will ensure that your assets and liabilities will be divided according to the terms agreed upon in the agreement and prevents the Family Courts from becoming involved if your relationship ends up breaking.
The agreement must comply with strict legal requirements under Family Law. Should the agreement not be done legally, it will not be upheld and you may have to fight things out in court.
